Consent searches in the Fourth Amendment Essay

The Fourth Amendment provides provisions that protect citizens from searches and seizures that are unreasonable. However, the individuals may waive their rights by consenting to searches. This essay is aimed at listing (Zalman, 2010), describing and explaining the rules regarding consent searches and providing a case study to illustrate the rules. When the court is called up on to determine whether consent was given for a search, it puts into consideration several issues. The first is that it considers the age, background and mental capacity of the subject. When the officer is seeking consent from the subject, he or she should not show weapons as that is considered to be coercive. In short, the officer should not use aggression to get the consent (Stephens & Glenn, 2006). The other rule is founded in the case Monroe v. Pape (1961) and which is based on the time the consent is sought. The rule requires officers to desist from seeking consents at night. Attempting to conduct a search at night is seen as evil and in a most obnoxious form (Zalman, 2010). Conclusion In conclusion, the law provides a waiver for the rights of protection from searches and seizures and the Fourth Amendment. However, the rules that govern such a waiver are so strict such that, an officer may find himself in breach easily if care is not exercised. These rules cover issues such as the mental capacity, age, time of getting the consent and the manner of soliciting such consent. Why Torture is a Good Thing. Recently the Speaker of the House of Representatives, Nancy Pelosi has come under fire for comments she made about torture, once again bringing the topic of torture back into the national spotlight. There are so many different sides to the debate on whether our government should or should not allow torture in the integration of suspected Al Qaeda members currently locked up in the United States military prison located in Guantanamo Bay, Cuba.There are those people who say that nothing good ever comes out of integration that uses anything that could be torture, but the truth is that is some of where our best intelligence in the War on Terror has come from the use of harsh integrating techniques. There are many different forms of intergation method that are uses by our government that have been called torture by those wishing to prevent them from happening. Our government loosly defines torture as any method of intergation that does not leave any physical d amage to the person that it is being used upon, there is nothing there about harsh intergation technique.There are many different forms of intergation tactects that are uses that have been called torture, but these methods do not physical harm nor to they leave any long term physical injures. The United States government does not use many of the traditional torture techniques that many foreign governments and Al Qaeda use; such as beatings, electric shock, and starvation. Waterboarding is one of the biggest intergation that has come under attack. Water boarding is preformed by tieing a person down with his feet raised above his head, then covering his mouth and nose.Finaly water is poured over there persons face, all this causes the mind to believe that the person is drowning. Even though no physical harm comes to the person; this technique is one of the most criticized forms of harsh integration techniques used. Water boarding is preformed on our own solders to prepare them for wha t they might have to live through if they are captured on the battle fields. Another form of integration techniques that is currently used is sleep deprivation. Sleep deprivation is not allowing the body to sleep enough, through the use of loud music or forcing the victim to stand.By not allowing the body to sleep it allows the mind to become weak and less defensive when being questioned, leaving the prisoners less likely to lie when questioned. Another technique that is used is the use of stress positions, which is placing a person in a position that becomes uncomfortable after a long period of time, such as standing, or kneeling for periods of up to four hours, no long term effects are caused by this. The pain that is felt is very real and at times very intense but it is gone as soon as they are allowed out of the stress positions. No long term damage has ever been cause by the use of stress positions.The critics of these harsh integration techniques call it torture, but they say nothing about what our men and women have been put through by foreign governments and foreign fighters through our history, and it still happening today. Many foreign countries use physical beatings to gather information, they have gone as far as breaking bones, and many times have beaten the victim to death. Al Qaeda and the Taliban have used these tactics along with beheadings of prisoners to try to scare our fighters, as well innocent civilians that Al Qaeda has kidnapped, since the beginning of the War on Terror. Where is the out cry from the world over that?All we are doing is trying to prevent another attack on our country. Some of the best intelligence we have gotten since the start of the War on Terror has come from the use of harsh integration techniques. The American government has stopped several terrorism attacks since the attack on September eleventh. 2001. Some of these would have been worse than that tragic September day, and how were these attacks prevented, by the u se of harsh integration techniques. The captured Al Qaeda and Taliban fighters are well trained and very loyal to the cause. Our government has tried normal integration techniques to no avail.These captured men would not talk until the use of these integration techniques was introduced. Once introduced many of these captured fighters broke and gave away plans that otherwise would have not come out. There is no other way to keep our country safe, other methods have been tried and have failed. Our government uses many techniques that may boarder on torture to gather information and to prevent another terrorist attack. In a perfect world there would be no use for many of these harsh integration techniques that are currently being employed by our government against Al Qaeda and the Taliban fighters.But unfortunately we do not live in a perfect world. Until Al Qaeda gives ups its desire to see America destroyed we need to what we can and we must continue to use these harsh integration te chniques. Our government does not view the use of sleep deprivation, water boarding, and stress positions; they are far more humane than what Americans soldiers have gone through by foreign governments when captured. The only way to keep America safe is to continue to use these intergation techniques until the threat possed by Al Qaeda is gone

African American Minority Group Essay

Among many of the ethnic groups that experienced a combination of segregation, racism, and prejudice; African Americans is one of the few that is still faced with one or more forms of discrimination today. The majority of African Americans came to the United States from Africa to be slaves, while others are citizens or residents of the United States from partial ancestry a form of the native population. In 1619, the first recorded Africans were recorded in British North America in Jamestown, Virginia, and the numbers began to increase as more English settlers died from harsh conditions and the Africans were brought to work as laborers. In the late 1700s the American Revolution occurred, which landed approximately 3 million Africans in slavery in the United States by the mid-1800s, (Centerwall, Brandon, 1984). In 1863 President Abraham Lincoln declared that all slaves in the United States from a Union were free. Meanwhile the declaration of Africans being free from slavery was joyful event, it was also the beginning of a growing battle that lead to a different approach of discrimination including; segregation, prejudice, and racism. By the 1900s, the African American population increased, which majority of the population lived in the Southern states of the United States. The Southern states enforced the Jim Crow laws, which mandated racial segregation in all public facilities giving white Americans advantages over black Americans in public schools, public transportation, restrooms, restaurants and drinking fountains. In order to eliminate the control that white Americans had over African Americans, African Americans began to build their own schools, churches, and communities. Although, African Americans building their own communities was the intention of avoiding the humiliation of the Jim Crow laws, it still didn’t prevent the African Americans from becoming victims of racially motivated violence. African Americans experienced countless acts of violence incidents that lead blacks battered, beaten and even dead in some cases. White Americans begin to form organizations that promoted white power, leading the organizations to practice out violence and destroy African Americans property. A popular white power organization called themselves the Ku Klux Klan and performed acts against blacks that included; lynching cross burnings, physical violence, and house burnings towards African Americans. Although, the Ku Klux Klan was formed in 1867, it has been rumors that there are people that are still secretly members today. African Americans experienced a wider range of discrimination, segregation, and racism more so in the later days but still arise in society today. In a perfect world, no one would be judged by the color of their skin and society would focus on a person’s individual true character. Often times African Americans miss out on opportunities because they are being judged by the color of their skin, rather than their abilities. The United States has tried to provide Americans the rights to equal opportunity, by creating the Affirmative action. The affirmative action eliminates people being granted opportunities based on their race, color, religion, gender, sexual orientation or national origin and ensures that minority groups within a society receive equal opportunities. Although, the affirmative action was intended to diminish situations which cause people to participate in different forms of discrimination, but unless it could be fully proven that African Americans were being passed up for jobs, education, income and other forms of advancements there will never be a way to fully prohibit this form of discrimination. Today, there is still unequal opportunities and discriminatory treatment that occurs in the United States especially with African Americans. African Americans were affected by many forms of discrimination that decreased advancement to equal other races in society. They were faced with dual labor market, forcing blacks to work in lower labor market areas. Redlining was enforced by keeping businesses from helping African Americans simply because of the area they lived in. Many African Americans wanted to better themselves by furthering their education, but suffered from institutional discrimination and given less information and aid for education. Knowing the history of the African American struggles on; prejudice, discrimination, and segregation allows me to understand my roots and accomplishments of my ethnic group. Personally the history of African Americans affects me greatly, because it is the combination of struggles that has played a huge role to my advancements and opportunities performed daily. The African American ancestors fought daily through all counts of discrimination helps that allows all groups of different minority groups the same equal rights for advancement opportunities. Although, the majority of the world views of African Americans has changed there are still people that choose to discriminate against African Americans by choosing not to change with the ways of the world and maintain prejudice. Acts of discrimination is performed but not as greatly as many years ago. African American culture has had a rough past journey, but in the long run the majority of the United States has made it possible for all African Americans equal rights and opportunities in life.
